Terms of Service

These Terms of Service ("Terms") govern your use of the LYFYE Readers mobile application and other LYFYE products and services (collectively, the "Services") provided by LYFYE ("we," "us," or "our"). By downloading, installing, or using our Services, you agree to be bound by these Terms.

1. Acceptance of Terms

By downloading, accessing, or using LYFYE Readers or any LYFYE Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not download or use the Services.

Parents and guardians are responsible for supervising their children's use of the App and for ensuring compliance with these Terms.

2. License to Use

Subject to your compliance with these Terms, LYFYE grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use our Services on devices you own or control, for personal, non-commercial purposes.

You may not:

• Copy, modify, distribute, sell, or lease any part of the Services
• Reverse-engineer, decompile, or disassemble the App or its source code
• Attempt to extract the source code of any LYFYE product
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices
• Use the Services for any commercial purpose without written permission from LYFYE
• Transfer your license to any other person or entity
• Use automated systems, bots, or scripts to interact with the Services

3. Content and Intellectual Property

3.1 LYFYE-Owned Content

All content within LYFYE Readers, including but not limited to stories, illustrations, character designs, animations, audio narration, music, user interface elements, and the overall look and feel of the App, is the exclusive property of LYFYE and is protected by United States and international copyright, trademark, and intellectual property laws.

The following characters are original creations of LYFYE and are protected intellectual property:

• Sir Gideon
• Princess Amara
• Captain Ace
• Luna
• Professor Wiki

These characters, along with their visual designs, backstories, and associated story content, may not be reproduced, distributed, modified, or used in any manner without prior written consent from LYFYE.

3.2 Historical and Public Domain Elements

Certain stories within the App feature historical figures and events that are in the public domain. While these historical elements are freely available, LYFYE's original story adaptations, narrative interpretations, illustrations, and character portrayals of historical figures are proprietary creative works owned by LYFYE.

3.3 Trademarks

"LYFYE," "LYFYE Readers," and associated logos and designs are trademarks of LYFYE. You may not use these trademarks without our prior written permission.

4. Subscriptions and Purchases

4.1 Free and Premium Content

LYFYE Readers includes a free tier with access to a selection of stories. A premium subscription unlocks the full story library, monthly story packs, and additional content including vocabulary exercises, activity sheets, and comprehension materials.

4.2 Subscription Management

All subscriptions are purchased through and managed by the Apple App Store or Google Play Store, depending on your device platform. Your subscription is subject to the terms and conditions of the applicable app store.

• Subscription pricing is displayed in the App and in the applicable app store before purchase
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period
• You may manage or cancel your subscription at any time through your Apple App Store or Google Play Store account settings
• No refunds will be issued for partial subscription periods. Refund requests are governed by the policies of the Apple App Store or Google Play Store

4.3 Pricing Changes

LYFYE reserves the right to modify subscription pricing. If we change pricing, we will provide advance notice through the App or the applicable app store. Price changes will not affect your current billing period and will take effect at the start of your next renewal cycle.

5. User Conduct

When using LYFYE Services, you agree to use them only for personal, non-commercial purposes, comply with all applicable laws and regulations, and supervise your child's use of the App.

You agree not to:

• Attempt to gain unauthorized access to the Services, their servers, or related systems
• Introduce viruses, malware, or other harmful code
• Interfere with or disrupt the operation of the Services
• Attempt to circumvent any content protection or access restriction mechanisms
• Use the Services in any way that could harm LYFYE, its users, or any third party

6. App Availability and Updates

LYFYE strives to keep the Services available and functioning properly, but we do not guarantee uninterrupted or error-free operation. We may release updates that modify features, fix issues, or add content; temporarily suspend access for maintenance or updates; or discontinue the App or specific features with reasonable notice.

We recommend keeping the App updated to the latest version for the best experience and access to all content.

7. Disclaimers

The Services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

LYFYE does not warrant that:

• The Services will meet your specific requirements
• The Services will be uninterrupted, timely, secure, or error-free
• The results obtained from the Services will be accurate or reliable
• The Services will be compatible with all devices or operating system versions

The content in LYFYE Readers is designed for educational entertainment. It is not a substitute for professional education, tutoring, or specialized instruction.

8. Limitation of Liability

To the maximum extent permitted by applicable law, LYFYE shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or interruption of service, arising out of or related to your use of or inability to use the Services, regardless of the theory of liability.

In no event shall LYFYE's total liability to you for all claims arising from or related to the Services exceed the amount you paid to LYFYE in the twelve (12) months preceding the event giving rise to the claim, or fifty dollars ($50.00), whichever is greater. Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, the limitations above apply to the fullest extent permitted by law.

9. Indemnification

You agree to indemnify, defend, and hold harmless LYFYE, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms, your misuse of the Services, or your violation of any applicable law or the rights of any third party.

10. Termination

LYFYE may terminate or suspend your access to the Services at any time, with or without cause, and with or without notice. Upon termination, your license to use the Services is immediately revoked.

You may terminate your use of the App at any time by uninstalling it from your device and canceling any active subscriptions through your app store account settings.

Sections 3 (Intellectual Property), 7 (Disclaimers), 8 (Limitation of Liability), 9 (Indemnification), and 12 (Governing Law) survive termination of these Terms.

11. Changes to These Terms

We may update these Terms from time to time. When we make changes, we will update the "Last Updated" date at the top of this page. For material changes, we will provide notice through the App. Your continued use of the Services after changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Services.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of North Carolina, United States, without regard to its conflict of law principles.

Any dispute arising out of or relating to these Terms or the Services shall be resolved exclusively in the state or federal courts located in North Carolina. You consent to the personal jurisdiction of these courts.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms shall remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and LYFYE regarding the use of the Services and supersede all prior agreements and understandings. For consulting engagements, specific terms of engagement are outlined in a separate Statement of Work (SOW) or Master Services Agreement (MSA).
